AIRBORNE CLASS ACTION SETTLEMENT HEARING TO BE HELD ON JUNE 16, 2008

Bonita Springs, Fla./Riverside, Calif. - U.S. District Judge Virginia A. Phillips will preside over a hearing on June 16, 2008, in Riverside, Calif., to consider final approval of the $23.3 million class action settlement of a lawsuit that challenged the advertising and labeling of the Airborne dietary supplement.

Airborne denies wrongdoing or illegal conduct and agreed to settle the lawsuit to avoid continued distraction from the business.

"The settlement doesn't mean that Airborne did anything wrong or broke the law," says attorney Bruce Colbath of the Weil, Gotshal & Manges law firm in New York, which represents Airborne. "This case has been a time-consuming and expensive distraction for Airborne's current management, so the company made a business decision to settle this lawsuit."

What Will Happen During and After the Court Hearing

The Court will hold a fairness hearing on June 16 at 10:00 a.m. at the United States District Court, Central District of California - Eastern Division, Riverside Courthouse, Courtroom 2, 3470 Twelfth Street, Riverside, Calif.

At the hearing, the Court will consider whether the settlement reached on August 28, 2007, between Airborne Health, Inc., Airborne, Inc., Knight-McDowell Labs, Victoria Knight-McDowell and Thomas "Rider" McDowell (Airborne's founders) and the plaintiff, David Wilson of San Bernardino, Calif., is reasonable and adequate. On November 29, 2007, the Court entered an order preliminarily approving the proposed settlement.

The Court will consider any objections to the settlement at the hearing and Judge Phillips will listen to people who have asked to speak at the hearing.

The Court will also determine the amount of fees and expenses plaintiff's attorneys should be awarded and whether an incentive payment should be awarded to Mr. Wilson.

At some point after the hearing, Judge Phillips will decide whether to approve the settlement. There is no time frame set for when Judge Phillips will issue her ruling.

The preliminary $23.3 million settlement fund will be divided among consumers who joined the class action and filed for refunds; the plaintiff; his attorneys, who include private practitioners in California; and the Center for Science in the Public Interest in Washington, D.C. Consumers have until September 15, 2008, to submit a claim. The claims administrator will approve and pay individual claims by October 15, 2008.

Discussions with Federal Trade Commission and State Attorneys General Continuing

In a related matter, Airborne attorneys are currently in discussion with the Federal Trade Commission and 26 state attorneys general to resolve their investigations into Airborne's advertising practices. Attorneys Helene Jaffe and Bruce Colbath of the Weil, Gotshal & Manges law firm, as well as A. Wes Siegner Jr. of the Hyman, Phelps & McNamara law firm in Washington, D.C., are representing Airborne in the FTC and state attorneys general inquiries.

"We hope to reach agreements with the Federal Trade Commission by mid-July and continue discussions with the state attorneys general," says Jaffe. "Those discussions have been cooperative and productive."

Because of the continuing nature of these matters, Airborne management is respectfully declining any requests for media interviews while the class action settlement, FTC and state attorneys general discussions are pending.
